Terms of Service

Version 2.6 · Effective September 25, 2026

These Terms govern use of SubTrench (the Service), operated by SubTrench Games (the Operator). By using the Service, a person agrees to these Terms. A person who does not agree must not use the Service.

1. Definitions

1.1 Service means the SubTrench game client, its game servers, and the Operator's pages, whether the game is accessed on subtrench.io or through a supported third-party portal.

1.2 User means any person who accesses the Service.

1.3 Virtual Items means Parts, Haul, levels, modules, frames, Scrap, hull finishes, stickers, patterns, trails, sonar styles, records, and every other in-game quantity or unlock.

1.4 Callsign means the display name a User submits before entering a session.

2. Nature of the Service

2.1 The Service is free, supports guest play without an account, and offers no real-money purchases. Optional accounts save progress between sessions. Parts and Scrap are earned in the game and cannot be bought with money.

2.2 The Service is under active development. The Operator may modify, suspend, reset, rebalance, or discontinue any part of the Service, including the whole of it, at any time and without notice or liability.

2.3 The Service is not for children under 13, and a child under 13 must not use it. A User who is at least 13 but not legally able to agree to these Terms may use the Service only after a parent or guardian reviews and agrees to them. Section 4 of the Privacy Policy explains how to report concerns about a child’s data.

3. Permitted and prohibited conduct

3.1 A User must not:

3.2 The Operator may block access from a User, address, or network to enforce these Terms or protect the Service and other Users. An access block may apply to an account, connection, address, or network.

3.3 A Callsign is displayed publicly on the leaderboard and in the kill feed, and may appear in wreck-salvage messages. The submitting User is solely responsible for its content. The Operator may filter, replace, or reject any Callsign.

4. Virtual Items

4.1 Virtual Items exist solely as state within the Service. They are not property, not currency, and carry no monetary value. No User acquires ownership of, or any transferable interest in, a Virtual Item.

4.2 Quests, achievements, Scrap, and cosmetics require an account. The server saves quest progress, discoveries, puzzle progress, achievement counters and unlock timestamps, score records, greatest depth, Scrap, owned hull finishes, stickers, patterns, trails, sonar styles, and selections to that account. It uses the selected hull finish, pattern, sticker, sticker placement, trail, and sonar style from the saved profile during gameplay. These saves load on sign-in across devices. Guests use the default appearance and can access combat, pressure trials, merchants, and exploration; guest exploration progress lasts for the current session. Callsign, guest greatest-depth record, and game preferences are stored in the browser when storage is available, or in page memory otherwise. Old guest cosmetic, achievement, and Scrap saves are ignored and are not imported into an account. On subtrench.io, browser-stored preferences do not transfer automatically to another browser or device. CrazyGames may back up browser storage and sync it for an authenticated User under its own terms. Clearing site data deletes that browser's copy, not necessarily a portal backup or a copy on another device.

4.3 Parts, Haul, level, modules, hull state, pressure clearance, and other session progress are held in server memory. After a connection interruption, the same open page may automatically reclaim that progress for up to 15 seconds. During that window, a signed-in User may also reopen the game and select Dive on the same server to recover the disconnected session in its original room. An active connection blocks another tab from joining that account. The grace is not guaranteed: live session progress is lost when it expires, the User returns to the main menu, a room is reset, or the server restarts. Death resets the depth limit to 1,200 m, so pressure trials must be repeated each life. Other respawn rules are described in How to Play.

4.4 The Operator may reset, rebalance, or remove any Virtual Item at any time. These changes do not entitle a User to compensation.

4.5 A User must not sell, buy, or transfer Virtual Items or access to the Service for money or anything else of value.

5. Advertising

5.1 At the effective date above, subtrench.io is awaiting AdSense approval and does not serve live Google advertisements. The game and Bestiary pages load the AdSense tag for site verification, but the direct-site build does not enable the separate Google H5 Games Ad Placement API. Development builds may show simulated ad placeholders. On a third-party game portal, the portal or its advertising SDK may serve live ads.

5.2 Where a live advertising provider is enabled, interstitial ads may appear after a death. Rewarded ads are optional; declining one only means the User does not receive the offered reward.

5.3 Third parties supply and control their advertisements. The Operator does not endorse their content. Advertising data handling is described in the Privacy Policy and may also be governed by the portal's or provider's own terms and privacy policy.

6. Intellectual property

6.1 The Service, including its source code, artwork, audio, name, and design, is owned by the Operator or its licensors and protected by copyright and other laws.

6.2 Users are granted a personal, revocable, non-exclusive, non-transferable license to access and play the Service. Copying, rehosting, redistribution, sale, and the creation of derivative works are prohibited without written permission, except where applicable law permits otherwise.

6.3 Users may capture, publish, and monetize screenshots, recordings, and live streams of their own play without further permission.

6.4 Feedback, bug reports, and suggestions submitted to the Operator may be used without restriction, attribution, or compensation.

7. Copyright complaints

7.1 A notice of claimed infringement must be sent to [email protected] and include:

7.2 The Operator will review complete notices and may remove the identified material.

8. Disclaimer of warranties

8.1 The Service is provided "as is" and "as available", without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.2 The Operator does not warrant that the Service will be available, uninterrupted, secure, or error-free, nor that sessions, records, or Virtual Items will persist. Servers are restarted and sessions are lost as a matter of routine operation.

9. Limitation of liability

9.1 To the fullest extent permitted by law, the Operator is not liable for indirect, incidental, special, consequential, or punitive damages, nor for loss of data, progress, Virtual Items, profits, or goodwill, arising out of or relating to the Service, whether or not advised of the possibility.

9.2 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

9.3 Where a jurisdiction does not permit an exclusion or limitation in this section, that provision applies only to the extent permitted. Statutory consumer rights are unaffected.

10. Amendment

10.1 The Operator may amend these Terms by posting revised Terms with a new version and effective date. Where applicable law requires additional notice or consent, the Operator will provide it. Continued use after the new effective date constitutes acceptance of the revised Terms.

11. Governing law and forum

11.1 These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict of law rules.

11.2 The state and federal courts located in New Jersey have exclusive jurisdiction over any dispute arising out of or relating to the Service, and each party consents to personal jurisdiction there.

11.3 Clause 11.2 does not deprive a consumer of the protection of mandatory law in their place of residence, nor of recourse to a competent small claims court.

12. General

12.1 If a provision is held unenforceable, the remainder continues in force.

12.2 Failure to enforce a provision is not a waiver of it.

12.3 These Terms and the Privacy Policy constitute the entire agreement concerning the Service.
